We value the privacy of individuals who use our website, app, and related services and as such strictly adhere to all legal and regulatory compliance requirements. This Privacy Policy, Cookie Policy, and Data Security Policy (collectively referred to as the "Policies") outline how SunoSunao collects, uses, shares, and protects personal information when you use our application (the "App"). As an intermediary based in India, we provide a platform for users to upload and share their creations (audio tracks), listen to tracks uploaded by others, and like/share/comment various such tracks on our app. By using the App, you consent to the collection, use, disclosure, and related practices described in these Policies.

This Privacy Policy applies exclusively to SunoSunao, its employees, including managers and directors, users, application providers and may not necessarily include its partners and/or any entity not owned or controlled by SunoSunao. Some of the provisions in this Privacy Policy apply exclusively to app providers and end users, whereas other provisions are applicable to both. If we become aware that we have collected personal information from a child without appropriate consent, we will take steps to delete it. If in case an under-aged person uses the app without providing the correct age, the parent or legal guardian may get in touch with us with a request to delete the information and we will do the same after necessary verification.

You have the choices and rights to your personal information regarding access, correction and deletion: You can access, correct and update or delete your personal information through your account settings.

We may also delete any information that would be against the law or could negatively impact the privacy of other persons, or if we are unable to identify you with the personal information submitted. 9. ACCESS FROM OUTSIDE INDIA

Our Services are hosted in India and we comply with the legal and supported regulatory requirements in India. If you choose to use the Services from outside India, e.g. the European Union or the United States of America, you would need to comply with your local jurisdiction with regards to holding, storing, processing, transferring personal information. By providing any information, including personal information, you have consented for holding, storing, processing, transferring such personal information.

10. COMPLIANCE STATEMENT

This is to confirm that as a best practice, SunoSunao has implemented policies and procedures to comply with the requirements of the Information Technology Act 2000 (the “IT Act) (as amended) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the “Rules”), including those for Social Media Intermediary and also the Digital Millennium Copyright Act (DMCA), United States of America.

• 10.1 Due Diligence:

  Privacy Policy, Copyright Claim & Unauthorized Use Reporting Form, and Terms & Conditions of Use are available on its website as well as within the applications for iOS & Android. The same are periodically updated in compliance with legal and regulatory requirements with all users notified of the same on the website.

  • SunoSunao further prohibits users from publishing objectionable content (defined in details in the Terms of Use) in compliance with IT Act and Rules.

  • SunoSunao has online mechanisms for receiving complaints and takedown requests in compliance with IT Act and Rules. Any such complaint may be reported through the app or addressed to the Grievance / Designated Agent.

  • SunoSunao confirms that on receipt of a written request for information from a lawfully authorized government agency clearly stating the purpose for which it is required, SunoSunao shall provide such information or assistance in its control and/or possession to the government authority within 72 hours. SunoSunao shall implement any order by a court of competent jurisdiction and/or appropriate government authority or its agency.

  • SunoSunao confirms that in compliance with the Rules, registration information from a user and/or information which has been removed or to which access has been disabled, shall be retained by it for a period of 180 days from the date of such withdrawal, removal or disablement.

• 10.2 Grievance Officer / Designated Agent:

  • Will acknowledge a complaint in relation to the Rules within 24 hours and dispose off such complaint within a fifteen days from the date of its receipt; and

  • Will receive and acknowledge any order, notice or direction issued by the Appropriate Government, any competent authority or a court of competent jurisdiction.
